Two more file lawsuits against KBL and UDV Over supply agreements

Due to concerns that the two beer producers would cancel their contracts, two more liquor distribution companies have filed lawsuits against Kenya Breweries Ltd. and UDV (Kenya). This has heightened competition among beverage distributors for a piece of the Nairobi and Kajiado markets.

According to Tony West Limited and Outlook Index Limited, KBL and UDV (Kenya) seek to hand over exclusive distributorship rights for 18 routes covered by the agreements to another business.

Their lawsuit comes days after KBL and UDV (Kenya) Ltd were sued by another pair of two businesses, Ngong Matonyok Wholesalers Ltd and Manara Ltd, over the intention to terminate distributorship contracts and exclusively provide the supply channels to a third party.

Some of the market regions that the four companies are fighting to retain were returned to another distributor, Bia Tosha Ltd, by the Supreme Court last week.

In a judgment dated February 17, 2023, the Supreme Court allowed Bia Tosha Distributors to regain exclusive control of 22 liquor distribution routes, which had been repossessed by KBL in 2016.
